Subject: Urgent Demand for Immediate CBI Enquiry and Stringent Action on the Justice A. Arumughaswamy Commission Report — G.O. No. SS.II/500-4/2022 dated 17.10.2022 — To Uncover Grave Lapses in the 75-Day Hospitalization Leading to the Tragic Demise of Late Hon’ble Chief Minister Selvi J. Jayalalithaa
Respected Sirs,
I, K. Jagadishwara Reddy, Founder President of Tamil Nadu Telugu Yuva Sakthi, approach you with this impassioned memorandum, demanding swift, uncompromising, and impartial justice. The unresolved shadows of negligence, interference, and systemic failure that shrouded the 75-day hospitalization and eventual demise of the Late Hon’ble Chief Minister of Tamil Nadu, Selvi J. Jayalalithaa, on December 5, 2016, represent a profound betrayal of public trust and a stain on our democratic institutions. The Justice A. Arumughaswamy Commission of Inquiry — constituted by the Government of Tamil Nadu through G.O. Ms. No. 817 & G.O. Ms. No. 829 (Public SC Dept.) dated 25.09.2017 and 27.09.2017 under the Commissions of Inquiry Act, 1952 — laid bare these shocking truths in its exhaustive report submitted on 27.08.2022. Yet, over three years later, the perpetrators evade accountability, mocking the rule of law and fueling public outrage. With the Tamil Nadu Assembly elections looming in 2026, it is imperative that this festering injustice be exorcised now, restoring faith in governance and ensuring a fair electoral process untainted by unresolved scandals.
The Commission’s meticulous probe, spanning 151-154 witnesses, 30 volumes of medical records, AIIMS consultations, toxicology analyses, and sworn affidavits, unequivocally exposed scandalous lapses and inconsistencies during the 75-day ordeal at Apollo Hospitals (from admission on September 22, 2016, amid fever, dehydration, respiratory distress, and uncontrolled comorbidities like diabetes and hypertension, to her heartbreaking cardiac arrest on December 5, 2016). These were not mere oversights but a cascade of preventable failures that hastened her decline:
Flagrant Negligence in Medical Management and Infection Control: Recurrent sepsis from Enterococcus faecalis (traced to untreated urinary tract infections, prolonged diaper use, and vaginal sources) went unchecked, leading to infective endocarditis, valve perforation, acute respiratory distress syndrome (ARDS), septic shock, and pleural effusions requiring repeated drainages. Delays in critical interventions — such as ignoring expert urgings for timely cardiac catheterization, surgery by a thoracic surgeon-led team (per European Society of Cardiology guidelines), and proactive fluid/protein management — exacerbated her suffering. The tracheostomy on October 7, 2016, and eventual ECMO on December 4 were reactive band-aids, not cures, amid thick secretions blocking airways and unmanaged comorbidities.
Egregious Breaches in Transparency and Oversight: CCTV footage was inexplicably switched off upon admission (citing vague security concerns), rendering verification impossible and breeding conspiracy theories. Daily health bulletins downplayed severity — omitting infections, left ventricular issues, and ARDS — while deputed government doctors were sidelined in waiting rooms, excluded from decisions, and reduced to spectators. External consultations from AIIMS, UK’s Dr. Richard Beale, and US experts (urging immediate surgery) were acknowledged but not acted upon, with Apollo Hospitals operating in isolation. Nominal thumb impressions for by-elections on October 27, 2016, amid her semi-conscious state, violated protocols and raised authenticity doubts.
Interference and Non-Compliance Undermining Care: Dietary restrictions (low-potassium, 1200-calorie liquids) were brazenly flouted with unrestricted home-cooked sweets, ice creams, and fruits prepared in the hospital kitchen, risking further infections and setbacks. Physiotherapy, though extensive (129 sessions), yielded minimal gains due to inconsistent enforcement.
The Commission rejected baseless rumors of conspiracy (e.g., poisoning or assault, disproved by toxicology and embalming reports showing no traces) but concluded her death stemmed from cardiac arrest amid these unmanaged infections and complications — a tragedy that timely diligence could have averted. It squarely indicted key figures for their culpable roles, demanding rigorous probes:
V.K. Sasikala (R.1): For undue interference, enabling non-compliant diets, and exerting influence that compromised care protocols.
Dr. K.S. Sivakumar (personal physician): For delayed pre-admission assessments and indifferent handling of initial fever.
Dr. J. Radhakrishnan (then Health Secretary) and Dr. C. Vijayabaskar (then Health Minister): For failing in oversight, allowing independent hospital decisions, and inadequate government intervention.
Dr. Y.V.C. Reddy, Dr. Babu Abraham, and Dr. Rama Mohana Rao (then Chief Secretary): For sidelining deputed doctors and not enforcing Cabinet-level protocols for VIP cases.
Dr. Pratap C. Reddy (Chairman, Apollo Hospitals): For transparency deficits, media mismanagement fueling doubts, and ethical lapses in team composition and record-keeping.
These damning conclusions, enshrined in G.O. No. SS.II/500-4/2022 dated 17.10.2022, scream for accountability. Yet, no criminal proceedings have materialized, permitting impunity and eroding public confidence — especially as Tamil Nadu gears up for the 2026 Assembly elections, where unresolved grief could undermine democratic legitimacy.
In light of these irrefutable revelations from the 75-day saga of suffering, we demand a CBI enquiry for all reasons: to dissect the web of negligence, interference, and cover-ups; to prosecute the guilty without fear or favor; and to prevent such institutional betrayals in the future.
Therefore, I earnestly implore:
That the Hon’ble Prime Minister and Union Home Minister forthwith direct the Central Bureau of Investigation (CBI) to launch an immediate, high-level probe into all facets of the Commission’s findings, holding the indicted individuals criminally liable.
That the Hon’ble Chief Minister of Tamil Nadu furnish unconditional cooperation, expeditiously transferring all documents, records, and evidence to the CBI, while implementing the Commission’s systemic reforms (e.g., mandatory expert consultations, transparent CCTV, and ethical protocols for high-profile cases).
That swift justice be delivered to honor Selvi J. Jayalalithaa’s legacy, vindicate the people of Tamil Nadu,
Yours faithfully,
(K. Jagadishwara Reddy)
